Terms & Conditions

1. Agreement: These terms and conditions (Terms) are between The Local Guys – Cleaning Pty Ltd (ACN 640 948 143) (we, us or our) and you, the person booking or receiving the Services (you or your).

2. Acceptance: You accept these Terms by making a booking or payment with us.

3. Services: We agree to provide the Services to you at the Premises on these terms and conditions.

4. Bookings: You may book Services through our website, or by contacting us. We reserve the right to decline any booking at our discretion. Once your booking has been confirmed we will provide you with a quote setting out the Fees payable by you.

5. Cancellations and rescheduling: You may request to cancel or reschedule a booking by contacting us. For cancellations or
rescheduling:

(a) with more than 24 hours notice: you may transfer your booking to another available time,
(b) with less than 24 hours notice (or where you are more than 10 minutes late or do not show): we reserve the right to forfeit your booking with no refund.

6. Your Obligations:

You agree that:

(a) you will comply with our reasonable requests and requirements;
(b) you will provide accurate information to us;
(c) any pets or animals at the Premises will be secured or kept away from the area where the Services are being provided to ensure the safety of both us and the animals;
(d) in the event of any unexpected changes or circumstances that may impact our provision of the Services, you will communicate promptly with us to make necessary adjustments to the Services or reschedule as needed; and
(e) you will not attend if you are suffering from any illness that could risk others health or safety.

7. Payment: Once your booking has been confirmed we will provide you with a quote setting out the Fees payable by you. Payment must be made in full on the day we provide you with the Services, except where we are providing you with an End of Lease/Bond Clean in which case payment must be made one (1) day before we provide you with the Services.

8. Late Payments: If you don’t pay us the Fees within fourteen (14) days of the agreed time, you must pay interest on the unpaid amount from the date it was due up to and including the date it is paid at the Default Rate of Interest, with interest accruing daily. We can also ask you to pay for any extra costs we face because you didn’t pay on time. This includes any costs we incur in getting those payments from you (including but not limited to any legal fees and debt collection agency fees we may incur).

9. Intellectual Property: Each party will maintain ownership of any intellectual property they independently create during the duration of this Agreement. There will be no transfer of intellectual property rights between the parties, except as explicitly outlined in this Agreement.

10. Termination for breach: This Agreement can be terminated by either party (the Non-Defaulting Party) with immediate effect if the other party (the Defaulting Party) fails to fulfill a significant obligation under this Agreement. If the Defaulting Party does not correct the breach within 10 business days after receiving written notice from the Non-Defaulting Party, the Non-Defaulting Party has the right to terminate the Agreement immediately.

11. Suspension:

We may suspend the provision of Services to you if:

(a) we reasonably suspect you are in breach of these Terms; and
(b) while we investigate the suspected breach.

If, following our investigation, we reasonably believe you are in breach of these Terms, we may terminate these Terms immediately by written notice to you.

12. Liability: We will perform the Services with reasonable care and skill. However, we are not liable for any indirect or consequential losses that may arise. Subject to your consumer law rights, our total liability under this Agreement and conditions is limited to the Fees paid by you.

13. Force Majeure: Each party releases the other from any claim, liability or responsibility pursuant to these Terms concerning the other party’s failure to perform any obligation where such failure is due to strike, lockout, riot, industrial action, fire, storm, tempest, act of God, material shortage, government law or regulation or requirement or any other cause beyond the control of the other party and no such failure shall entitle a party to terminate this Agreement.

14. Confidentiality: Both parties commit to maintaining the confidentiality of any proprietary or confidential information shared while these Terms are in place.

15. Subcontracting: We reserve the right to subcontract any portion of the Services at our discretion without needing to get your written approval beforehand. We commit to being fully responsible for fulfilling our obligations under this Agreement, and we will ensure that any subcontractors we employ will adhere to the terms of this Agreement as if we were performing the Services directly.

16. Relationship of Parties: This Agreement is not intended to create a partnership, joint venture, employment or agency relationship between the parties.

17. Governing Law: This Agreement is governed by the laws of South Australia.

18. Dispute Resolution: In the event of a dispute, the parties will first attempt to resolve the matter through mutual discussion or mediation.

19. Amendment: any amendment or variation to these Terms must be agreed in writing by the parties.

20. Definitions:

(a) Default Rate of Interest means a rate of interest 2% above the Reserve Bank of Australia cash rate;
(b) End of Lease/Bond Clean means the end of lease/bond cleaning services provided by us, details of which are set out below;
(c) Fees means the fees payable by you as will be as set out on our website, in our online booking form or in person when you book;
(d) Premises means the premises nominated by you for us to provide the Services;
(e) Services means the commercial, domestic and carpet cleaning services provided by us in accordance with the quote issued to you and as set out on our website, in our online booking form or in person when you book.

Inclusions & Exclusions: The Local Guys Cleaning

Our End of Lease/Bond cleaning aims to clean the property to satisfy the Managing Agent (under the governance of the Residential Tenancies and Rooming Act 2008) of the cleanliness of that property for the tenant to have their bond released. 

Our End of Lease/Bond return Guarantee only covers the areas you have chosen to use our services (T&C’s Apply). 

Please see thelocalguyscleaning.com.au full term’s and conditions. Please understand that an End of Lease/Bond can consist of many different components. It is your duty to ensure you have covered them all. For instance, a complete End of Lease/Bond clean usually consists of the following: 

  • End of Lease/Bond clean (Deep clean of the property) 
  • Carpet Shampooing (Stain removal not included) 
  • For Steam clean please specifically ask as this is a separate service 

And if required any specialty services like: 

  • Upholstery Cleaning 

Our quoting processes covers the items above individually, please make sure you have checked your quote for the inclusions of the service. Note: Each item will appear on the quote as a separate service. For instance it will appear as: 

  • End of Lease/Bond Clean 
  • Carpet Clean

The Local Guys Cleaning use the latest cleaning products and techniques to fulfil a service however at times ‘normal wear and tear’ applies as it is not possible for us to get the item back to it’s original state. We will however take before and after photos of some items to prove to the Managing Agent that without specialist intervention this is the best condition the item can be restored to. 

End of Lease/Bond Cleaning Inclusions (Unfurnished Property)

The following services constitute our End of Lease/Bond cleaning service at The Local Guys Cleaning. 

General:

  • Removal of Cobwebs, Insect marks and Small nests where Pest Control is not warranted  Clean Fans, Air conditioners and Filters  
  • Clean Light Fittings (where they can be safely removed and accessible) Light Switches and Power Points 
  • Cleaning Skirting, Architraves and Doors 
  • Clean Drawers and Cupboards including inside, Doors and Cupboard tops and Shelving Windows Clean both sides (exclusions apply at heights and accessibility) Vacuum Sliding Door Tracks and Clean Tracks  
  • Clean Standard Blinds, Cords and Rails (Sport clean and dust) 
  • Vacuum all the Floors and Carpets  
  • Mop Hard Floors 

Kitchen: 

  • Clean inside, outside and on top of all Cupboards, Doors and Drawers Clean inside, outside and around Stove Top, Elements, Rings and Knobs Clean inside and outside of Oven, Griller, Doors, Trays, Racks, Glasses and Knobs Clean inside, outside and behind Refrigerator, Dishwasher and Microwave space (if applicable) 
  • Clean and Dry Sink, Drain holes, Drainers and Polish Tap Ware 
  • Range Hood Exhaust and Filter (If Filter can be removed and cleaned) 
  • Clean and Polish Splash Back area 

Bathroom: 

  • Clean Exhaust Fans 
  • Clean inside and outside all Cupboards and Drawers 
  • Clean Toilet, behind ‘S’ bend, around Cistern and under & around the Toilet Seat Clean Bath, Shower Recess and Removal of built up soap residue on Tiles, Shower Screens and Soap Holder 
  • Clean Sink and Polish all Tapware and Towel Rails 
  • Clean Mirrors and floors

Laundry: 

  • Clean inside and outside of all Cupboards & Drawers 
  • Clean inside, outside and behind Dryer (Removal of Lint - if applicable) Clean inside, outside and around Laundry Tub, Cabinets, Shelves, Drawers & Tapware Clean behind Washing Machine space. Clean equipment and Filters (If applicable).

Garage: 

  • Sweep Floors 
  • Removal of Cobwebs

Patio: 

  • Sweep and Mop Floors  
  • Removal of Cobwebs 

Furnished: 

  • Dust and Wipe over furniture surfaces 
  • Kitchen Cupboards will be cleaned if ALL ITEMS are removed and placed in front of the Cupboard. WE TAKE NO RESPONISBLITY or have no liability for any damaged or breakages of Cupboard items 

Note: Standard Blinds are blinds with a surface that can be dusted or cleaned without requiring a specialist and or extra time. For instance, material blinds or curtains would require a Blind specialist. Venetian and Roller blinds will be quoted separately based on the number of blinds in the property. Furnished properties will require a separate quote. 

Cleaning behind and around these items or any heavy objects (as per our Terms and Conditions) over 5kg must be moved by the client (and put back if applicable) for our cleaners to gain access and clean. 

Additional Services (Will Be Quoted Separately):

The following services will be quoted separately and will appear on your quote as separate items. 

Note: If they are not listed on your quote they will not be included as part of the cleaning service. 

This list is not definitive. We have only listed some of the common requests, other speciality services exist such as house repairs and painters etc 

  • Carpet Cleaning 
  • Blinds eg. Venetian 
  • Pest Control 

End of Lease/Bond Cleaning Exclusions:

These items are excluded from our End of Lease/Bond clean: 

  • Mould - We will try our best to remove mould from areas however sometimes mould can be imbedded into the silicone, grout and other areas making it unlikely to completely remove. These areas will require a specialist to restore back to it’s original state.
  • Damp Spots - Damp spots can happen anywhere in the house. This often occurs on a ‘dry wall’ plaster. We will do our best to remove any mould and marks from damp spots however we cannot completely make these spots disappear. These marks can return quickly due to excess moisture. 
  • Discolouration - We will do our best to clean all the items with our commercial experience however discolouration can occur with ‘normal wear and tear’ of the property. Often grout, toilets and plastics can discolour (often in a yellow colour) over time and they can’t be returned to their original colour without specialist intervention.
  • Tile and Natural Rock Stains - We do our best to remove stains however due to the composition of the tiles or benchtops it is not possible to remove stains without specialist intervention. 
  • Ceilings - We do not service ceiling cleans. 
  • Dangerous Areas - Any areas considered by our cleaner as dangerous to operate will not be serviced. This includes broken cracked PowerPoints/Switches, Rubbish, Bio Waste or any other hazards which are deemed dangerous. 
  • Heights - Our cleaners do not clean at heights. Any cleaning that requires a ladder will not be serviced. For instance, Windows in a unit complex on the second floor. Garage Walls - We do not clean Garage walls or floors 
  • Specialist Services - Areas that require special cleaning equipment, specialist chemicals or a trained technician. Examples are Pressure Cleaners (grease on garage floor), painters (walls extremely bad) or plasterer (holes in walls) 
  • Additional Items - Items such as Fridges, Furniture or any items not listed in the inclusions will not be cleaned unless otherwise agreed upon both parties in writing Furnished - We will not clean inside Cupboards if the items have not been removed. Kitchen Items (Furnished if applicable) - We do not offer nor warrant all kitchen items that occupy cupboards and draws 
  • Furnished Property Exclusions - We do not clean or warrant ‘nick knacks’, Picture frames, Vases, Lamps, Clocks, Fruit Bowls, Linen and any items that may be decorative. 

End of Lease/Bond Back Guarantee (T&C’s Apply) Exclusions With The Local Guys Cleaning: 

As well as the End of Lease/Bond cleaning exclusions, other exclusions exist that we can’t warrant under the End of Lease/Bond back guarantee. 

  • Outside Areas - Outside areas that cannot be fully protected (closed off) from weather elements. Examples are balconies and patios, or any areas that cannot be completely closed off such as an outside area of a house with only three walls. As per our inclusions we will clean any outside area as required however due to weather circumstances we cannot warrant these areas 
  • Post Pest Control - We will not be responsible and do not warrant items post pest control that may require additional cleaning directly related to pest control. Examples include  dead insects or animals that have accumulated due to pest control being applied to the property. 
  • Garage - We do not warrant any cleaning inside or outside of the garage Kitchen Items (Furnished if applicable) - We do not warrant or clean all kitchen items that occupy cupboards and drawers. We refrain from removing the oven glass or door during the cleaning process due to the high probability of breaking or damaging the glass.
  • Completion Events - A completion event is an event that has happened after the End of Lease/Bond and within the warranty period which may influence the Managing Agents release of the bond in which the bond cleaner is not responsible for. We will not be responsible nor guarantee cleanliness in such an event. To determine these events please confirm with The Local Guys Cleaning when requesting a quote. Some examples include: Build up of dead insects that were alive during the clean, Insect or Animal faeces, A build up of surface dust that has settled after a clean, New residents have moved or moved in and Access to the property by a third party contractor that has not been approved by us.

Furnished Property Exclusions:

We do not clean or warrant ‘nick knacks’, Picture Frames, Vases, Clocks, Fruit Bowls, Linen and any items that may class as decorative.
